Privacy Notice for Tesseract
TESSOP is the data controller for this historic art project. We may collect and process personal data in content you submit to create a time capsule preserving cultural moments for hundreds of years.
What data do we collect?
Content you submit, which may include images of you and others (personal data if identifiable).
Purpose and legal basis
We process this data for the artistic purpose of archiving in a physical time capsule. The legal basis is your explicit consent (Article 6(1)(a) GDPR). If photos reveal special category data (e.g., ethnic origin or health via biometrics), we rely on explicit consent under Article 9(2)(a) GDPR.
Storage and retention
Content will be stored digitally during collection, then transferred to a physical medium and sealed in the time capsule upon project implementation and completion. Once sealed, the capsule will be stored indefinitely for future generations. Digital copies can be deleted after sealing and locking of the content for the capsule, if you wish, except for backups needed for project integrity.
Your rights under GDPR (European General Data Protection Regulation)
- Access, rectify, or restrict processing of your data.
- Withdraw consent at any time before the capsule is sealed (contact us at contact@memocube.org). Withdrawal won’t affect prior lawful processing.
- Right to erasure (“right to be forgotten”) — however, once sealed, this may not apply under Article 17(3)(d) GDPR, as the processing is for archiving in the public interest, and erasure would seriously impair the project’s artistic and historical objectives.
- Object to processing or lodge a complaint with a supervisory authority (your local DPA).
We don’t share data with third parties except as needed for the project. No automated decisions or international transfers occur.
2. Your Consent upon Participation
Upon participation you will give explicit consent for the Tesseract Project to process your personal data as follows:
1. Submission Details
I confirm that:
- I am the owner of the content(s) or have rights to submit them.
- For any content including other identifiable individuals, I have obtained their explicit consent and will provide proof if requested. If minors are included, I am their parent/guardian or have their parent/guardian’s consent.
2. Purpose
The content(s) will be included in a physical time capsule as part of an art project to preserve cultural snapshots for hundreds of years. This involves collection, temporary digital storage, printing/transfer to physical media, and permanent archiving.
3. Grant of Rights
I grant the Tesseract Project a perpetual, irrevocable, worldwide license to use, store, and display the content(s) in the time capsule for artistic and archival purposes. I waive any moral rights or claims to compensation.
4. Permanence Acknowledgment
I understand that once the time capsule is sealed, the content(s) cannot be physically removed due to the project’s design. Digital copies will be deleted post-sealing. The right to erasure under GDPR may not apply after sealing, as this qualifies as archiving in the public interest (Article 17(3)(d) GDPR), where removal would impair the project’s objectives.
5. Data Protection
I have read the Privacy Notice and understand my rights, including withdrawal of consent before sealing. Withdrawal after sealing may not result in removal due to the above exemption. Data will be handled securely and in compliance with GDPR.
6. Consent Statement
I freely consent to the above processing. This consent is specific to this project and can be withdrawn before sealing.
